General Terms and conditions
1. Definitions
- Service Provider: Faery Snail Tours, hereinafter referred to as “we,” “our,” or “us,” headquartered in Utrecht (The Netherlands).
- Client: The individual, group, or entity booking services, hereinafter referred to as “you” or “your.”
- Agreement: The binding contract formed upon acceptance of these Terms and Conditions by the Client.
- Force Majeure: Any unforeseeable event beyond the control of either party, including but not limited to natural disasters, pandemics, strikes, and government restrictions.
2. Applicability
These General Terms and Conditions govern all bookings, services, and transactions conducted through Faery Snail Tours. By booking with us, you confirm your agreement to abide by these terms.
3. Services Offered
Faery Snail Tours specializes in:
- Thematic group tours.
- Tailored private tours.
- Cultural and educational experiences.
- Art and wine workshops in collaboration with local partners.
4. Booking Process
- Bookings are confirmed upon receipt of payment or deposit as stipulated in the booking confirmation.
- A written confirmation will be provided via email, including the itinerary, pricing, and cancellation policy.
- The Client must ensure that all provided information is accurate and up-to-date.
5. Pricing and Payment
- All prices are quoted in USD/EUR and include applicable taxes unless otherwise stated.
- Payment methods accepted: credit card, bank transfer, and secure online platforms.
- Full payment is required no later than [30 days] before the scheduled tour unless specified otherwise.
6. Cancellation Policy
Cancellations are subject to our Cancellation Policy, which is incorporated by reference. Please review the policy for detailed terms.
7. Changes and Amendments
- Changes to bookings requested by the Client are subject to availability and may incur additional fees.
- We reserve the right to make minor adjustments to itineraries due to unforeseen circumstances without prior notice.
8. Travel Requirements
- It is the responsibility of the Client to ensure compliance with all visa, passport, and health requirements.
- Travel insurance is strongly recommended to cover unforeseen expenses, including medical emergencies.
9. Liability
Faery Snail Tours is not liable for:
- Delays or interruptions caused by Force Majeure events.
- Injuries, loss, or damage incurred during the trip unless due to negligence on our part.
- We are committed to ensuring the safety and comfort of our Clients but recommend individual travel insurance.
Faery Snail Tours complies with applicable Dutch and international laws regarding travel agency operations, including maintaining the following insurance coverages:
- Professional Liability Insurance: Covers damages caused by errors or negligence in professional services.
- General Liability Insurance: Protects against claims for bodily injury or property damage arising during business operations.
- Insolvency Protection: Faery Snail Tours has measures in place to protect customers in the unlikely event of company insolvency, ensuring refunds and repatriation where necessary.
Customers are encouraged to purchase additional travel and cancellation insurance for their trips. Faery Snail Tours will not be liable for any losses beyond the scope of its insured coverage.
10. Code of Conduct
- Clients are expected to adhere to local laws and customs during tours.
- Disruptive behavior, disrespect towards guides or fellow travelers, or violation of local laws will result in immediate termination of services without refund.
11. Intellectual Property
All content on our website, itineraries, and promotional materials is the intellectual property of Faery Snail Tours and may not be reproduced without prior consent.
12. Complaints
- Complaints should be reported immediately to your tour guide or to Faery Snail Tours’ customer service at customercare@faerysnail.com.
- Formal complaints must be submitted in writing within [14 days] of the tour’s conclusion.
13. Applicable Law and Jurisdiction
Faery Snail Tours is a sole proprietorship registered in the Netherlands and operates in compliance with Dutch law. Any agreements, terms, or disputes arising in connection with our services are governed by the laws of the Netherlands.
In the event of a dispute, the parties agree to submit to the exclusive jurisdiction of the competent court in Utrecht, the Netherlands. This clause does not limit any rights the customer may have under mandatory consumer protection laws applicable in their country of residence.
14. Amendments to Terms
We reserve the right to amend these Terms and Conditions. Clients will be notified of any significant changes at least [30 days] prior to implementation.
